1. RETAINER FEES & PAYMENT
A non-refundable retainer fee will be due at the time of booking. This will reserve your session date & time. The payment for printed product will be due at the time of your ordering appointment, or can be paid at the time of booking the session in a pre-order. Additional products or digital images can be purchased during your gallery viewing appointment. The retainer fee will guarantee your selected time slot. The contract will be presented to you when you arrive for your session and must be signed before photos can be taken. Please print this page to retain a copy of the contract.
2. BEFORE YOUR SESSION
Plan arrive 10 minutes early for your session. If your child takes a while to warm-up, you can arrive earlier and it may help if they can see other children interacting with Santa.
Family portraits will be taken first. There will be a mix of classic, posed portraits as well as portraits of children interacting with Santa.
If an illness or emergency circumstance prevents you from attending your scheduled session, you may reschedule your session at least 24 hours prior to the scheduled shoot without penalty – however, unless there is a follow-up date, the back-up session will not include Santa. If client should fail to give 24 hours’ notice, the retainer will be forfeited and will not be refunded.
I reserve the right to reschedule or cancel due to illness or emergency circumstance. In the unlikely event that this occurs, I will make every effort to reschedule your session. If rescheduling is not possible, your retainer will be returned to you.
5. IMAGES, ORDERING & DELIVERY
Your Session proofs will be available for selecting and ordering within 2-3 weeks of your session date, via a private gallery. Due to the custom nature of each session, all sales are final. Images not selected within 60 days will be considered abandoned with no refund possible. Print and product orders are placed through a professional printing company and will be available to ship within 15 business days.
Lisa Bigness is not responsible for the damage of portraits or products once delivered to the client. Client assumes all responsibility for the safety of the portraits upon receipt. Photographer will archive session photos for 1 month. After the 1-month period, there will be a $100 fee to re-open the gallery. Due to the time sensitive nature of some of the products, orders containing greeting cards will be prioritized.
6. MODEL RELEASE
Photographer prefers that all clients sign a Model Release form, giving the photographer irrevocable and unrestricted rights to use and publish client photographs for any purpose. This could include promotions, advertising, portfolio display, and any other marketing material, etc. The client releases and discharges photographer from any and all claims in connection with the use of the photographs taken.
7. COPYRIGHT & REPRODUCTIONS
Lisa Bigness and Sweet Baby Bliss Portraits LLC retains all copyright to images created during a client’s session. A print release is provided for purchased full resolution digital files to allow client to print portraits for personal use. Copying, scanning, downloading, printing, sharing or altering any image created during your session is strictly forbidden without the photographer’s written permission, As is using any image produced by Lisa Bigness and Sweet Baby Bliss for commercial purposes or for monetary gains, up to and including marketing materials, advertisements, and other circumstances where a commercial license may be deemed appropriate.
RAW and unedited images are never made available for sale and are the intellectual property of Lisa Bigness. Clients will only receive carefully retouched images that fit the style portrayed by Sweet Baby Bliss portraits by lisa bigness.
In the unlikely event of an injury, the photographer should not be liable for any injury to the client or any participating parties during the session or immediately following the event. Client will take responsibility for themselves and any other participating party and fully release the photographer from any claims against their person or business
Please be mindful of all children in the studio. There is heavy photography equipment and props everywhere. Extra care must be taken to ensure that there is always a watchful guardian for children, including removing the child/children who have already have had their portraits taken and are no longer needed for additional portraits. This safety measure is in place to protect curious little ones.
9. ATTORNEY FEES
If either party brings legal action against the other party, to secure the specific performance of this contract, collect damages for breach of this contract, or otherwise enforce this contract, the prevailing party shall cover all reasonable attorney’s fees and all costs and expenses incurred in the action.
